3 Day Rental Agreement – Non-Payment of Rent
The first step in the eviction process is to provide a 3-day notice of eviction. A 3-day notice is provided to a tenant if there is a verbal/oral or written rental agreement. A 3-day notice is used to inform the tenant to either pay the rent due or vacate the premises. In most cases, providing a 3-day notice of eviction will result in payment of rent due. Notice may be posted on the door of the rental property or hand-delivered to the tenant. If payment of past-due rent is not received or the tenant does not comply with the notice within the allowed time, the landlord may file an eviction complaint with the court clerk. A copy of the 3-day notice must be included with the eviction complaint when it is filed. 30 Day Notice of Termination with No Rental Period Specified – Regain Possession of Property
(This form is primarily used for anything other than non-payment of rent.) If no rental period is specified or a written lease is not in place, you may still terminate the lease for failure to pay rent, evict the tenant, and regain possession. When evicting a tenant for possession in this situation, you must provide the tenant with a 7-day or a 30-day notice to vacate. If the rent is paid weekly, you must give a 7-day notice. If the rent is paid monthly, you must provide a 30-day notice. The 30th day must be no later than the date rent is due again. If payment of past-due rent is not received or the tenant does not comply with the notice within the allowed time, the landlord may file an eviction complaint with the court clerk. A copy of the 7-day or 30-day notice must accompany the complaint at the time of filing.
